Bankruptcy Process – Quick Look:

 

FIRST STEPS

  • Complete questionnaire
  • “Consumer Credit Counseling” course or “Pre-Bankruptcy” class required
  • Get a Certificate of Completion
  • Need copies of your payroll stubs or payment advices for the last 60 days
  • Need a copy of your last Federal Tax Return

NEXT STEPS

  • Customer enters a contract with We Help You Services, LLC for document preparation
  • Service Fee due – $200
  • We Help You Services, LLC prepares the bankruptcy documents
  • Customer reviews and signs the bankruptcy documents
  • File Fee due: $306 (MUST be in the form of a “Postal Money Order”)
  • Bankruptcy documents are filed with the U.S. Bankruptcy Court
  • Mail/fax a copy of your last Federal Tax Return to the Trustee BEFORE the Meeting of Creditors date

FINAL STEPS

  • Customer is required to attend a Meeting of Creditors
  • Financial Management course required
  • Need to get a Certificate of Completion and file with along with Official Form 23 with the Court, which is customer’s responsibility
  • Entire process usually takes from 3 1/2 to 4 months

Bankruptcy Process – Detailed:

  • Take the “Consumer Credit Counseling Course”  or “Pre-Bankruptcy” class at www.AbacusCC.org or call (800) 516-3834.  You will be issued/mailed a “Certificate,” which I will need before your bankruptcy can be filed.  This is a MANDATORY.
  • Get copies of your payroll stubs or payment advices for the last 60 days (or 2 months).  Ask your company to provide you copies if you did not save them.
  • Get a copy of the “last” Federal Tax Return you filed.  If you do not have it, go online at www.irs.gov/taxtopics/tc156.html or call (800) 829-1040 to get a “Tax Transcript” sent to you.  If necessary, you can get a FREE copy of your credit report(s) at www.AnnualCreditReport.com.  You must provide us with a list of the name, address, account #’s and amounts owed for “ALL” of your creditors that you owe money to and are including in your bankruptcy.
  • Once you have completed ALL the above requirements, please Contact Us or call (805) 237-7770 and an in person appointment will be set.  You will be asked to enter a contract with We Help You Services, LLC and your $200 payment will be due.
  • It takes about a week to prepare your bankruptcy.  Once completed, we will either schedule another appointment or mail the documents to you for your review and signature.
  • Once your bankruptcy documents are thoroughly reviewed and signed, the $299 filing fee is necessary to file the documents with the U.S. Bankruptcy Court.  The $306 filing fee MUST be a U.S. Postal Money Order that you get from any U.S. Post Office.
  • Once your bankruptcy is filed with the U.S. Bankruptcy Court, you and your creditors will be notified of the date and time of your “Creditor’s Meeting” or “341 Meeting of Creditors” which is usually scheduled about a month after the documents are filed.
  • IMPORTANT:  Once your bankruptcy documents are filed, a Trustee will be assigned to your case.  The Trustee’s name, address and phone number will be provided to you by the bankruptcy court.  10 days BEFORE your scheduled “Creditor’s Meeting,” YOU MUST mail or fax a copy of your last Federal Tax Return to the Trustee.  Call the Trustee with questions.
  • Once you have attended the “Creditor’s Meeting,” you have 45 days from the first date set to complete a “Financial Management” course and file with the Court a “Certificate of Completion” and “Official Form 23 or Form B23.”  This is YOUR responsibility to ensure this requirement is met.  Otherwise, your bankruptcy will be “closed” without receiving a “discharge of debts” and YOU will have to “re-open” your case and pay another filing fee to receive a “discharge of debts.”  This is a critical last step in the entire bankruptcy process.  Goto  www.AbacusCC.org or call (800) 516-3834 to get your “Certificate of Completion.”  There is a small fee ($25 to $75).
  • From start to finish, the entire bankruptcy should take about 3 1/2 to 4 months.  Once you have filed your bankruptcy with the U.S. Bankruptcy Court, your creditors should not be calling you or trying to collect debts.
