There are many common misconceptions about bankruptcy. I have been preparing Chapter 7 bankruptcy petitions for nearly 20 years. One of the biggest misconceptions is that people cannot file a Chapter 7 anymore…I am not sure where this misconception has come from, but is it incorrect. As a Bankruptcy Petition Preparer, I only help with very simple bankruptcy petitions. Until January 2001, for many years, Paralegals or Legal Assistants, were offering legal document services to the public for a fee. To make a long story short, the Paralegals who worked for attorneys were upset and ultimately led to the creation of the profession of Legal Document Assistant (LDA). Today, Paralegals must work under the direct supervision of an attorney and LDAs must go through a Registration process with the California County in which they will be advertising and preparing their documents. Paralegal Assistance Unlimited (paralegalunlimited.com), 1305 2nd Street, Los Osos, CA @ 805-304-1044, who also has an office in Fresno, is willfully and knowingly violating the law. The owner of Paralegal Assistance Unlimited, Irene Zupko, knows she is not supposed to be using the word “Paralegal” in her company name or advertising as a “Paralegal” if she is performing LDA services, but chooses to do so anyway. Sure, she can advertise and work as a Paralegal, but there are restrictions. Below is the pertinent law citation:
“California, Business and Professions Code, Section 6452. (a) It is unlawful for a person to identify himself or herself as a paralegal on any advertisement, letterhead, business card or sign, or elsewhere unless he or she has met the qualifications of subdivision (c) of Section 6450 and performs all services under the direction and supervision of an attorney who is an active member of the State Bar of California or an attorney practicing law in the federal courts of this state who is responsible for all of the services performed by the paralegal. The business card of a paralegal shall include the name of the law firm where he or she is employed or a statement that he or she is employed by or contracting with a licensed attorney.”
