A notary public (or notary or public notary) is a public officer constituted by law to serve the public in non-contentious matters usually concerned with estates, deeds, powers-of-attorney, and foreign and international business. A notary’s main functions are to administer oaths and affirmations, take affidavits and statutory declarations, witness and authenticate the execution of certain classes of documents, take acknowledgments of deeds and other conveyances, protest notes and bills of exchange, provide notice of foreign drafts, prepare marine protests in cases of damage, provide exemplifications and notarial copies, and perform certain other official acts depending on the jurisdiction. Any such act is known as a notarization.

Help with Legal Services – San Luis Obispo, Paso Robles, Arroyo Grande, Grover Beach, Santa Maria, Atascadero and Los Osos

I have been offering low cost and quality legal documents to the Central Coast for many years. It is truly a pleasure to be able to help and offer consumers affordable/low cost legal access to the judicial system. Customers seeking help from the court’s family law facilitator (court sponsored/ran), legal aid, senior center, rural legal assistance (CRLA.org) and senior services centers in general are not often able to get the help they are looking for. In most instances I am able to help, but in many occasions, consumers are not aware of my type of service, so recently I have make a concerted effort to get the word out to the public. There is nothing more frustrating to a consumer of legal services to not be able to get the help/information or answers to simple questions…which is my specialty! If I am not able to help consumers that are seeking help/information from the family law facilitator, legal aid, senior center, rural legal assistance (CRLA.org) and senior services center, then I will try and find a low cost resource to send the customers to.

Bankruptcy – San Luis Obispo, Paso Robles, Arroyo Grande, Grover Beach, Santa Maria, Atascadero and Los Osos

Posted on 01/06/11 No Comments

There are many common misconceptions about bankruptcy. I have been preparing Chapter 7 bankruptcy petitions for nearly 20 years. One of the biggest misconceptions is that people cannot file a Chapter 7 anymore…I am not sure where this misconception has come from, but is it incorrect. As a Bankruptcy Petition Preparer, I only help with very simple bankruptcy petitions. We have offices in Paso Robles, San Luis Obispo and Arroyo Grande, but serve Atascadero, Morro Bay, Los Osos, Oceano, Grover Beach and Santa Maria. Our fee is $200, plus a $299 file fee. If a person does not own a home or business and has a moderte income and expenses, then it is likely they would qualify for a Chapter 7 Bankruptcy. If you are considering bankruptcy, please visit our website at www.wehelpyoulegal.com and click on “Legal Services” and goto “Bankruptcy.” There is a quick qualifier and gives details about the entire bankruptcy process. Thank you. Carl Knoll @ 805-237-7770 or carl@wehelpyoulegal.com

Consumers Beware – LDA Vs. Paralegal (Paralegal Assistance Unlimited)

Posted on 01/06/11 No Comments

Until January 2001, for many years, Paralegals or Legal Assistants, were offering legal document services to the public for a fee. To make a long story short, the Paralegals who worked for attorneys were upset and ultimately led to the creation of the profession of Legal Document Assistant (LDA). Today, Paralegals must work under the direct supervision of an attorney and LDAs must go through a Registration process with the California County in which they will be advertising and preparing their documents. Paralegal Assistance Unlimited (paralegalunlimited.com), 1305 2nd Street, Los Osos, CA @ 805-304-1044, who also has an office in Fresno, is willfully and knowingly violating the law. The owner of Paralegal Assistance Unlimited, Irene Zupko, knows she is not supposed to be using the word “Paralegal” in her company name or advertising as a “Paralegal” if she is performing LDA services, but chooses to do so anyway. Sure, she can advertise and work as a Paralegal, but there are restrictions. Below is the pertinent law citation:

“California, Business and Professions Code, Section 6452. (a) It is unlawful for a person to identify himself or herself as a paralegal on any advertisement, letterhead, business card or sign, or elsewhere unless he or she has met the qualifications of subdivision (c) of Section 6450 and performs all services under the direction and supervision of an attorney who is an active member of the State Bar of California or an attorney practicing law in the federal courts of this state who is responsible for all of the services performed by the paralegal. The business card of a paralegal shall include the name of the law firm where he or she is employed or a statement that he or she is employed by or contracting with a licensed attorney.”

In January 2001, a California law was enacted that created the profession of Legal Document Assistant (LDA).  There is an educational requirement and a registration process.  In order to perform the services of an LDA, a person must prove their education/experience, register in the county in which they will be preparing their documents and post […]
